Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs how you may use the Brain Buddy AI Studio platform ("Platform") operated by Brain Buddy AI Pty Ltd. This policy is part of our Terms of Service. Violation of this policy may result in suspension or termination of your account.

1. Permitted Use

The Platform is designed for legitimate business purposes, including:

  • Deploying AI chatbots to assist website visitors with enquiries
  • Capturing leads and booking appointments
  • Providing automated customer support
  • Answering frequently asked questions
  • Qualifying prospects and routing to human agents

2. Prohibited Uses

You must not use the Platform to:

2.1 Harmful or Illegal Content

  • Generate, distribute, or facilitate illegal content or activities
  • Promote violence, hatred, discrimination, or harassment
  • Create chatbots that provide medical, legal, or financial advice without appropriate disclaimers and professional oversight
  • Facilitate fraud, scams, phishing, or other deceptive practices
  • Distribute malware, spam, or unsolicited communications

2.2 Deceptive Practices

  • Impersonate a human without disclosing that the chatbot is AI-powered (the AI disclaimer must remain enabled or an equivalent disclosure must be provided)
  • Make false or misleading claims through the chatbot
  • Collect personal information under false pretences
  • Use the chatbot to manipulate or deceive visitors

2.3 Data Misuse

  • Collect sensitive personal information (health records, financial account numbers, government IDs) through the chatbot without appropriate security and consent measures
  • Sell or share visitor data collected through the chatbot with third parties without visitor consent
  • Use the Platform to build databases of personal information for unsolicited marketing
  • Scrape, harvest, or systematically extract data from the Platform

2.4 Platform Abuse

  • Attempt to circumvent usage limits, rate limiting, or fair use policies
  • Use automated tools to generate artificial conversations or inflate usage metrics
  • Reverse engineer, decompile, or attempt to extract the source code of the Platform
  • Interfere with the Platform's infrastructure, security, or other users' access
  • Resell or redistribute Platform access without authorisation
  • Use the Platform to benchmark or build a competing product

2.5 Regulated Industries

If you operate in a regulated industry (healthcare, financial services, legal, etc.), you are responsible for ensuring your chatbot complies with all applicable regulations. This includes:

  • Adding appropriate disclaimers (e.g. "This is not medical/legal/financial advice")
  • Ensuring the chatbot does not make claims that require professional licensing
  • Complying with industry-specific data handling requirements
  • Maintaining human oversight for sensitive enquiries

3. Fair Use

3.1 Message Limits

Each subscription plan includes a monthly message allowance per chatbot. These limits are designed for normal business operations. Messages exceeding the monthly limit are charged as overages at $0.01 AUD per message.

3.2 Resource Limits

  • Chatbots: Limited by plan (1 to 25 per organisation)
  • Knowledge sources: Limited by plan (3 to unlimited per chatbot)
  • System prompt size: Maximum 50,000 characters
  • Response length: Maximum 400 tokens per AI response

3.3 Abuse Detection

We monitor usage patterns to detect abuse. Abnormal usage patterns (such as automated message generation or deliberate limit circumvention) may result in account review and potential suspension.

4. Content Responsibility

You are responsible for the content your chatbot delivers to visitors, including:

  • Knowledge base content you provide
  • Custom instructions and prompts
  • Welcome messages, quick chips, and CTA phrases
  • AI-generated responses based on your configuration

We recommend regularly reviewing your chatbot's conversations to ensure response quality and accuracy.

5. Reporting Violations

If you become aware of any use of the Platform that violates this policy, please report it to abuse@brainbuddy.ai. We investigate all reports and take appropriate action.

6. Enforcement

Violations of this policy may result in:

  • A warning and request to correct the behaviour
  • Temporary suspension of chatbot(s) or account access
  • Permanent termination of your account
  • Reporting to relevant authorities where required by law

We will make reasonable efforts to notify you before taking action, except where immediate action is required to protect visitors, other users, or the Platform.
